Telehealth / Telemedicine Consent
By using this telehealth/telemedicine platform, the patient consents to engaging with qualified doctors registered with the Malaysia Medical Council (MMC), holding a valid practising certificate, under the Telemedicine Act 1997 (Malaysia). This may include healthcare delivery, information sharing, and transfer of health-related data via text, picture, audio, video, or data communication.
The patient understands there are potential risks with this technology, and that consultation, diagnosis, and treatment cannot be fully performed via virtual consultation alone due to its limitations.
The patient understands their rights and the following limitations
- The right to withhold or withdraw consent at any time, without affecting future care/treatment or any program benefits.
- Confidentiality under the Personal Data Protection Act 2010 — information disclosed during the session remains confidential, and no personally identifiable images or information will be shared without consent, except: to the attending healthcare provider/supervisor for continuing care, or to an employer/insurer whose benefits or policy covers part or all of the cost of services obtained.
- Risk that transmission of medical information could be disrupted or distorted by technical failure.
- Telehealth-based care may not be as complete as face-to-face consultation; the doctor will advise if a face-to-face consultation is needed instead.
- Telehealth is not appropriate for medical emergencies — emergency department care should be sought instead.
- No physical examination takes place during a virtual session, which limits diagnosis/treatment; this platform does not serve as a diagnostic or therapeutic service on its own.
- The patient agrees to hold the service providers harmless against claims arising from use of the platform, except in cases of negligence, default, or fraud on the part of the service providers, staff, or medical practitioners engaged through the platform.
